Subscription Agreement

This Subscription Agreement is a binding contract between you and Artap governing your use of Artap’s subscription service (“Subscription Service”)—a premium offering of the Artap photo editing app (“the App”) that provides access to exclusive features, content, and benefits. By subscribing to, accessing, or using the Subscription Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement, as well as our Terms of Service and Privacy Policy (incorporated herein by reference). If you do not agree to these terms, do not subscribe to or use the Subscription Service.

1. Subscription Service Overview

The Subscription Service grants subscribers unlimited, on‑demand access to the following premium benefits (“Premium Benefits”) for the duration of the active subscription term, unless otherwise modified by us:

• Full access to all AI style transfer presets, including exclusive styles not available via one‑time coin purchases.
• Unlimited use of all premium templates, including seasonal and themed templates.
• Ad‑free app experience.
• Early access to new features, styles, and templates.
• Priority customer support.
• No watermarks on edited content.
• Additional creative assets such as exclusive stickers, custom fonts, and high‑resolution export options.

We reserve the right to add, remove, or modify Premium Benefits at any time, provided that such changes do not materially reduce the overall value of the Subscription Service during an active subscription term. We will notify you of material changes via in‑app notification or, where applicable, email.

2. Eligibility

To subscribe to the Subscription Service, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction).
• If between 13 and 18 years old, have obtained explicit consent from your parent or legal guardian, who is deemed to have agreed to this Agreement on your behalf.
• Have a valid account with the applicable app store and meet its eligibility requirements.
• Comply with our Terms of Service and Privacy Policy.

We reserve the right to refuse or terminate subscriptions for any individual who fails to meet these eligibility criteria or violates this Agreement.

3. Subscription Plans, Pricing, and Payment

3.1 Available Plans

• Monthly Plan: automatically renewing monthly access to Premium Benefits.
• Annual Plan: automatically renewing annual access, typically at a discounted rate.
• Trial Plan: limited-time free trial access available to new subscribers only.

All plans are subject to availability, and we may discontinue, modify, or add plans at any time as permitted by law.

3.2 Pricing

Subscription pricing is displayed in the App’s subscription section at the time of sign‑up. Prices are quoted in your local currency (as determined by the app store) and may include applicable taxes. We may change prices from time to time, with changes taking effect only at the next renewal term. You will be notified of any price increase in advance and may cancel if you do not agree.

3.3 Payment Processing

All subscription payments are processed exclusively through the app store from which you downloaded the App (“Payment Processor”). By subscribing, you authorize the Payment Processor to charge your selected payment method for the subscription fee at sign‑up and at each renewal. We do not store or process your credit card or other sensitive payment details.

3.4 Free Trial Terms

• Free trials are available only to new subscribers who have not previously subscribed.
• Unless you cancel before the end of the trial period, your trial will automatically convert to a paid subscription, and your payment method will be charged for the first term.
• You may cancel at any time during the trial period to avoid charges.

4. Subscription Renewal and Cancellation

4.1 Automatic Renewal

All subscriptions automatically renew at the end of each subscription term (monthly or annually) unless you cancel before the renewal date. If payment fails, the Subscription Service may be suspended until payment is successfully processed.

4.2 Cancellation

You may cancel your subscription at any time via your app store account settings. Cancellations take effect at the end of the current term; refunds for unused portions of a term are not provided unless required by applicable law.

4.3 Refunds

Except where required by law, subscription fees are non‑refundable. If you believe you are entitled to a refund under applicable law, please contact the Payment Processor directly, as they handle all billing and refund processing.

5. Access to the Subscription Service

• Activation: upon successful subscription or trial activation, access to Premium Benefits will be enabled in the App and linked to your app store account.
• Device limits: access may be limited to a certain number of devices signed into the same app store account.
• Suspension/termination: we may suspend or terminate your access if you violate this Agreement, fail to pay, engage in fraud or abuse, or where required by law.

6. Intellectual Property Rights

• All Premium Benefits and subscription features are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, personal, non‑transferable license to use them within the App during your active subscription.
• You retain ownership of the content you create or edit using the Subscription Service. Our use of your content is limited to providing and improving the Service as described in the Privacy Policy.

7. Modifications to This Agreement

We may update this Agreement from time to time to reflect changes in the Subscription Service, legal requirements, or industry practices. When material changes are made, we will notify you via the App or your app store account, and your continued use after the effective date will constitute acceptance of the revised Agreement.

8. Disclaimer of Warranties

THE SUBSCRIPTION SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SUBSCRIPTION SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION SERVICE IN THE 12 MONTHS PRIOR TO THE CLAIM.

10. Governing Law

This Agreement is governed by the laws of the State of California, United States of America, without regard to conflict‑of‑law principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Los Angeles, California.
